MARLAN’S DELUXE through its website www.marlansdeluxe.com sells second-hand luxury Products.
These general conditions of sale govern the offer, forwarding, and acceptance of purchase orders for products made exclusively through www.marlansdeluxe.com.
Each user is required to accept the General Conditions of Sale and all related contents (hereinafter referred to as "GCS") during the purchase process on the Site.
Marlan’s Deluxe reserves the right to modify the GCS without notice.
Contract conclusion
The contract is to be considered stipulated as soon as the customer sends his order to Marlan’s Deluxe. The receipt of the order is communicated to the customer through an order confirmation automatically generated and sent to the e-mail address indicated by him.
The receipt of the automatically generated order confirmation does not imply any confirmation that the product is also available or can be delivered. The order confirmation simply informs the customer that the order has been received by Marlan’s Deluxe, and therefore the contract is in place while remaining subject to the condition of the possibility of delivery.
Registered users
You must be at least 18 years of age and have the full legal capacity to make purchases on the Site.
When completing the purchase procedure, the user can save personal data to facilitate subsequent purchases.
Products availability
The availability of the Products refers to the actual availability at the time the user places the order. However, this availability must be considered purely indicative.
Even after sending the order confirmation email, there may be cases of total or partial unavailability of the goods. In this case, the order will be rectified with the elimination of the unavailable product, and the user will be promptly informed via the email address indicated.
Products
The Site sells luxury, second-hand, and 100% authentic bags and accessories.
International shipments
The buyer will bear all taxes and customs charges. If the buyer refuses to pay taxes and customs duties, causing the item not to be collected or refuses to collect it, Marlan’s Deluxe will retain the value of the order, and the transaction will be considered concluded. Failure to collect does not allow the buyer to request cancellation of the order. The buyer can then request the return of the item, upon payment by bank transfer, of the shipping cost.
If for any reason, it is impossible to deliver the product to the purchaser. For example, if an incorrect address is provided, the product will be kept available to the purchaser at his own risk, and costs (including transport and storage costs) for 6 (six) months.
If the buyer fails to pay within 6 months of the order date, the object will become the property of Marlan’s Deluxe.
Shipping and delivery
Marlan’s Deluxe ships only to Switzerland. International shipments will be possible in the future, but the relative conditions are agreed upon on a case-by-case basis. This is carried out by communicating directly with the buyer via email.
The shipment is generally made within 5 (five) working days from the date of order confirmation, and in any case within the maximum term of 30 (thirty) days.
Marlan’s Deluxe uses Swiss Post to ship parcels to Switzerland. Marlan’s Deluxe sends a confirmation email as soon as the order is shipped. Packages have a tracking number with which you can track and manage the delivery.
Risk transfer
The Products remain Marlan’s Deluxe property until the full value of the order is received, inclusive of the price of the Product and all additional costs (including taxes, processing fees, and shipping costs).
The risks associated with the loss and potential damage of the Product become those of the purchaser when the purchaser or a third party specified by him physically comes into possession of the Product.
Upon delivery of the Product by the courier, the buyer should verify (or have the person receiving the Product verify) the apparent state of the Product.
If there’s an easily detectable defect (damage, missing products, damaged packaging, etc.), the purchaser or third party in charge should indicate such defects on the delivery receipt, indicating precisely the number of missing packages or products. or damaged and accurately describing the nature of the problem encountered (open or damaged packaging, missing or damaged products, etc.).
Warranty
The Products offered are second-hand, and therefore Marlan’s Deluxe does not offer any type of guarantee.
However, Marlan’s Deluxe guarantees the authenticity of all the Products on sale.
Cancellation and return
The buyer has the right to cancel the order within five (5) days from the order confirmation by communicating it via email. If the package has already been prepared and the tracking code has already been passed on to the buyer, the sale will be canceled, but the buyer will refund the shipping costs.
The buyer can exercise the right of return within 14 (fourteen) days from receipt of the order (for orders delivered in Switzerland) and within 14 (fourteen) days for international orders. In case of a dispute, the courier delivery date will prevail.
In case of purchase, selecting the payment option "Purchase by invoice with partial payment option.” The right of return ceases when the buyer informs Marlan’s Deluxe that the product is received and accepted. Such communication should occur within five (5) days from receipt of the products.
The buyer who intends to return the Products must do so by sending an email, indicating the order number and name of the user. Any returns of the Products must be sent to the following address respecting the procedure described in the return request email:
The shipment must take place within 7 (Seven) days of receipt of the Products (within 14 for international shipments).
The package shipment must be tracked, and the tracking number must be communicated to Marlan’s Deluxe by email. Marlan’s Deluxe declines all responsibility in the event of loss or damage to a Product during transport.
After receiving the Product, it is examined. The Product must be in the same condition it was shipped (with all accessories, undamaged, and with labels attached and intact). The return will be accepted only and exclusively if it meets all the conditions described above.
If the return is accepted, Marlan’s Deluxe processes the refund as soon as possible, and in any case, within 30 (thirty) days of the return notification. The refund will be made using the same method used to make the payment. Marlan’s Deluxe undertakes to reimburse the amount spent on the order by the buyer, excluding any additional out-of-pocket expenses incurred, such as shipping costs.
If the return is refused, Marlan’s Deluxe will send the Product back to the buyer, after receiving the shipping costs by bank transfer. If the buyer rejects the delivery (after 30 days), the item will be relisted, and the buyer can no longer recover it.
Data processing

Intellectual property
Marlan’s Deluxe is the owner of the texts, images, and contents of the Site. No part of the Site may be copied, reproduced, modified, distributed, published, or transmitted without authorization. All trademarks, product names, company names, and logos on the Site are the express property of their respective owners.
Languages
These GCS are drawn up in English and then translated into other languages with mechanical systems. In case of discrepancies, the French version prevails over the others.
Liability
Marlan’s Deluxe’s liability in connection with the Products purchased through the Site is strictly limited to the cost of the specific product.
To the extent permitted by law, Marlan’s Deluxe does not accept liability for indirect damages.
